These Terms and Conditions ("Terms") govern your use of the Drimystic Records platform, website, and services (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old to use the Service. If you are under 18, a parent or legal guardian must create the account on your behalf and accept these Terms. By using the Service, you represent that you meet these requirements and have the legal capacity to enter into a binding agreement.

You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate, current, and complete information at registration.
• Keep your password confidential and notify us immediately of any unauthorized access.
• Use only one account at a time on Free or paid plans (Label plan allows multiple artist accounts under one subscription).
• Be at least 18 years old and legally able to enter into contracts.

By uploading music to the Service, you grant Drimystic Records a non-exclusive, worldwide, royalty-free license to:

• Encode, format, and deliver your music to streaming stores and platforms.
• Store, host, and process your audio files, artwork, and metadata.
• Display your release information in your dashboard and our public marketing materials (with your permission).
• Aggregate and report streaming and revenue data to you.

You retain all ownership rights to your music. We claim no ownership of your masters, compositions, or artwork. This license terminates when you remove your content from the Service or close your account.

You represent and warrant that:

• You own or have obtained all necessary rights, licenses, and clearances for the music you upload — including master rights, publishing rights, and any samples or featured artist contributions.
• Your music does not infringe on any third party's copyright, trademark, or other intellectual property rights.
• Your metadata (ISRC, UPC, credits) is accurate and not misleading.
• You will comply with each store's content policies and guidelines.
• You have obtained all necessary consents from collaborators, producers, and featured artists.
• You are solely responsible for any royalty splits you configure.

You may not:

• Upload music that infringes on third-party copyright, including unlicensed covers, samples, or remixes.
• Use the Service to distribute content that is illegal, defamatory, hateful, harassing, or sexually explicit (without proper content warnings).
• Manipulate stream counts, royalty data, or engagement metrics (streaming fraud).
• Resell, sublicense, or white-label the Service without written permission (Label plan branding allowed).
• Attempt to reverse-engineer, scrape, or overload our systems.
• Use the Service for money laundering or other financial crimes.

Violations may result in immediate account suspension, takedown of your releases, and forfeiture of pending royalties.

The Service offers four subscription tiers: Free, Starter, Professional, and Label. Pricing is displayed on our pricing page and may change with 30 days' notice.

• Subscriptions are billed monthly or annually in advance.
• Payments are processed by Stripe, PayPal, or Razorpay.
• You may cancel anytime — cancellation takes effect at the end of your billing cycle.
• Refunds are governed by our Refund Policy.
• Taxes (GST/VAT) are added where applicable.

On paid plans (Starter, Professional, Label), you receive 100% of the royalties your music generates from stores, minus any payment processor fees for withdrawals. On the Free plan, we retain 15% of royalties as a distribution commission.

• Royalties are reported by stores 2–3 months in arrears and credited to your dashboard balance.
• Minimum withdrawal: $50 USD (or local equivalent).
• Payouts process in 3–5 business days via your selected method.
• You are responsible for any taxes owed on your royalty income.
• We provide annual tax statements for your records.

The Service, including its design, features, branding, and software, is the intellectual property of Drimystic Records and is protected by copyright, trademark, and other laws. You may not:

• Copy, modify, or distribute our branding, logos, or content without permission.
• Use our trademarks in a way that implies endorsement or partnership.
• Reverse-engineer or decompile our software.

You retain all intellectual property rights in your music, artwork, and metadata uploaded to the Service.

You may close your account at any time from your dashboard. We may suspend or terminate your account if:

• You violate these Terms or any store policies.
• You engage in streaming fraud or copyright infringement.
• Your account is inactive for 12+ months.
• Required by law or to protect our platform.

On termination, your music will be taken down from stores within 30 days. Pending royalties will be paid out if above the minimum threshold. We will retain data as required by law (see our Privacy Policy).

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that:

• Your music will be accepted by every store or appear on specific playlists.
• The Service will be uninterrupted, error-free, or secure.
• Specific revenue or streaming results will be achieved.

Store policies, payout rates, and editorial decisions are beyond our control.

To the maximum extent permitted by law:

• Drimystic Records shall not be liable for indirect, incidental, special, consequential, or punitive damages.
• Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
• We are not liable for any loss of revenue, profits, or data resulting from store takedowns, policy changes, or service interruptions.

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Any disputes will be resolved in the courts located in Los Angeles County, California. EU and UK consumers retain the right to bring claims in their local courts under mandatory consumer protection laws.

We may update these Terms from time to time. We will notify you of material changes by email and post a notice on our website 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
